SCO MUST REVEAL DISPUTED CODE

As I said in the previous item, SCO has sued IBM claiming that IBM had caused proprietary Unix code to be included in the Linux Kernal. However, SCO were reluctant to identify the code in question.

Last Friday, 5th December, one of IBM's counter-suing cases came up. They had demanded SCO hand over all Linux source code and other Linux material they claimed they had rights over.

The court ruled that SCO had 30 days to respond to the demand. SCO must describe exactly how IBM is infringing SCO's intellectual property rights. Also SCO has to show that IBM, rather than SCO, passed the Unix source into Linux.

Hopefully, we will have a clearer picture in the new year of precisely what SCO is claiming and subsequently whether they have a valid claim, or whether they are spreading Fear Uncertainty and Doubt (FUD).
